—BAKERY POLICY—

 

Business Terms and Conditions

When placing an order with Tay’s Sweet Shop (hereinafter “Me,” “My,” “I,” “Tay’s Sweet Shop”, “The Bakery”), you (hereinafter “You,” “Your,” “Customer,” “Client”) agree to the following Terms & Conditions:

 

Accepting the terms and conditions and submitting payment establishes a legally binding agreement between you and Tay’s Sweet Shop.

 

*My Guarantee

Tays Sweet Shop will provide a professionally decorated dessert as specified. I appreciate your business and are honored that you have chosen my bakery for your special celebration. I guarantee that the flavors, size, and general design elements will be met. However, if you are unsatisfied with my product(s), please let me know within 24 hours after you receive your order. Prompt notification of any dissatisfaction will help me resolve any issues in a timely manner.

 

*Design and Consultation

You may select from my existing portfolio, or I can design something unique for you. I will follow your requests closely to create your desired design.

 

*Artistry

When you agree to my business terms and conditions and pay for your order, you agree that any items ordered will be reproduced as Tays Sweet Shop’s interpretation of the item and will not be a replica. Tays Sweet Shop reserves the right to exercise artistic licensure to guarantee the structural, visual, and creative integrity of a cake or dessert structure. Custom cakes are a work of art; therefore, I will not copy the work produced elsewhere due to copyright or trademark laws. The finished product(s) will be as similar as possible. I will make every attempt to provide the design as requested, including matching colors. 

 

*Inquiries

I will send you a price quote within seventy-two hours of your request. Please make sure to submit payment within 72 hours of the price quote if you would like to proceed. Your event date is secured, and your order is confirmed upon receipt of the booking fee. 

 

*Orders

 

Celebrations

Must be secured with a booking fee at least one month before the required collection or delivery date. Sometimes my bakery can accommodate an order with shorter notice, so please contact me to discuss your needs. A convenience fee may apply if Tays Sweet Shop accepts your short notice, depending on design.

 

Weddings

Must be secured with a booking fee at least four months before the required collection or delivery date. Sometimes my bakery can accommodate an order with shorter notice, so please contact me to discuss your needs. A convenience fee may apply if Tays Sweet Shop accepts your short-notice wedding order.

 

*Booking Fees & Payments

The booking fee is due when the order is placed and represents your acceptance of all order details. Tays Sweet Shop will only treat your order as confirmed once your booking fee has been received. Tays Sweet Shop will only hold your collection or delivery date if the booking fee is received within three days of the invoice date. After this time, your date is not guaranteed and will be available to other customers.

 

• All celebration orders under $200 require payment in full at the time of booking.

• All celebration orders over $200 require a booking fee of 50%. Short notice orders placed within fourteen days of the collection date are an exception and must be paid in full at the time of ordering.

• All wedding orders require a booking fee of 50% to secure your order. This fee is non-refundable. Short notice orders placed within two months of the wedding date are an exception and must be paid in full at the time of ordering. Wedding orders totaling less than $250 require full payment at the time of ordering.

 

Payment in full is still subject to the cancellation and refund policy. All orders hold a 50% NON-REFUNDABLE RETAINER. 

 

Please note that all booking fees are NON-REFUNDABLE and NON-TRANSFERABLE. If Tays Sweet Shop needs to cancel your order, I will refund any booking fees paid. Reasons Tays Sweet Shop may need to cancel include but are not limited to death, injury, illness (due to health and safety regulations), severe medical conditions, or an accident of myself or any immediate family member. Please be understanding if such incident occurs. 

 

If an refund is being issued due to returning of any items, please allow 3-5 business days for the refund to reflect back to the original payment method. 

 

Preferred Methods of Payment

Online via Square Invoice, CashApp, PayPal, Zelle or ApplePay. 

 

Final Balance Payments

• Celebration orders (over $200) – final payment is required 10 days before the collection/delivery date.

• Wedding orders – final payment is required two months before collection/delivery date.

 

Non-Payments

Tays Sweet Shop will only complete an order if paid for in full. If the invoice is not paid in full before or on the payment due date, you forfeit your order and absolutely no refund, future credit, or date change will be permitted under any circumstances.

 

Tays Sweet Shop does not accept responsibility for any loss, howsoever caused for non-payment. Therefore, if the total amount of an order is not received by the due date, I will mark the order as canceled. The cancellation policy applies in all cases. If you attempt to make payment after the due date, Tays Sweet Shop reserves the right to refuse your payment; accordingly, you will forfeit your 50% booking fee. In addition, if Tays Sweet Shop chooses to resume work on the order, you will be charged a late fee of 15% of the total cost of the order (excluding taxes). Payment is due at the time of confirmation. 

 

*Collection (Pick up)

Collection dates are scheduled at the time of ordering. I can make arrangements for certain holidays with a service fee of $20.

 

Collection is available for all items ordered. 

 

Please be on time to collect your order. You have a 20-minute window to pick up your order. Unfortunately, I cannot guarantee that I will available outside your collection window. Therefore, a fee of $10 will be applied every fifteen minutes beyond your collection window. If I am not at the premises and/or pickup is 24+ hours after agreed collection time, a late fee of $45 will be applied. Late fees must be paid to collect your order. 

 

If you cannot make your scheduled collection time, please email/text/call to reschedule. If you do not reach out to reschedule your collection time at least 2 hours prior, the late fee will be applicable. 

 

If you or your designee opt to pick up your order and opt not to have Tays Sweet Shop deliver to your event/venue, you agree to releasing the bakery of any responsibility for damage that might occur during transport.

 

Upon pickup of your order and its departure from the premises, you or your designee waive any rights to a refund based on the product's style, design, or visual appearance(s). Tays Sweet Shop will not accept liability for any damage sustained to any product(s) once it has been collected. If you would like to see your product/s prior to pickup, please let me know. 

 

*No Call, No Show Orders

Any order that is not picked up at the agreed-upon time or within 24 hours, without an attempt to reschedule is forfeited, and absolutely no refund, future credit, or date change will be permitted under any circumstances. 

Order(s) may be donated to charity or resold at the discretion of Tays Sweet Shop.

Because of the nature of my business and my quality and freshness assurance, I will dispose of any items that have not been picked up or delivered within 48 hours after the specified collection time has passed.

 

*Delivery

Delivery should be arranged at the time the reservation is placed or as soon as possible afterward. The delivery charge covers our time, fuel costs and set-up. The cost of delivery is based on mileage and time. If delivery has not been arranged within a week of booking, you will be expected to collect your items at the bakery premises. 

 

It is your responsibility to ensure that you have provided the correct delivery information and to ensure that the venue is open and available at the arranged time. At the venue, should we have to wait to gain entry, you will be billed for the time at a rate of $50 per hour. If no one is available to receive the order at the agreed delivery time, your order will be returned to my bakery, and I will contact you to arrange an alternative delivery or pickup time; for which a charge will be assessed. Tays Sweet Shop accepts no responsibility for any loss or consequential loss incurred by the customer as a result.

 

Tays Sweet Shop is not responsible for any delay or inability to deliver based on accidents, natural disasters, transportation issues, inclement weather, illness, death, labor troubles, delay of supplies, disputes, strikes, or any other circumstance beyond Tays Sweet Shop control. If such occurs, I will notify customer/s immediately. 

 

In the case of an unavoidable situation, such as a car accident or poor road conditions during delivery, Tays Sweet Shop cannot be held liable for more than the cost of the order.

 

*Set up

This service includes unboxing and placing the desserts on their respective displays, touch-ups, floral placement, and final designs.  Please ensure any display pieces you provide are on the cake table before our arrival.  We do not offer full table design, draping, and lighting.  This is best left to you or your coordinator prior to our arrival. Additional fees will apply.

 

*Date Changes, Order Changes & Cancellations

If, for any reason, you need to revise your occasion date, I will try my best to accommodate these changes at no additional cost, provided sufficient notice and the new occasion date is available. I will do my best to accommodate your order, but we CANNOT GUARANTEE the availability. The booking fee/retainer will not be refunded if I am fully booked for your new occasion date. Please bear this in mind when ordering; any monies paid are NON-REFUNDABLE and NON-TRANSFERABLE. 

 

-NonWedding Events

If you are changing your order, please allow at least 3-4 weeks notice for any type of refund. 

If you are changing your order within 14 days of the due date, there will be no refund - a credit will be applied to a future order, if ordered within 6months of order change. 

 

-Wedding

 

If you are making changes to your wedding order, please submit these requests within 1.5-2 months prior to due date. 

 

 *Wedding Cancellation :

—If you are cancelling your order with 60+ days before the due date, the NON-REFUNDABLE RETAINER will not be refunded. You will receive refund of the balance remaining after the retainer. 

— If you are cancelling your order with 40-60 days before the due date, the NON-REFUNDABLE RETAINER will not be refunded. You will receive a 50% refund of the balance remaining after the retainer. 

— If you are cancelling your wedding date within 35 days of the due date, the NON-REFUNDABLE RETAINER will not be refunded. You will receive a 25% refund on the balance remaining after the retainer. 

 

*Tastings

Tays Sweet Shop offers cake tastings for wedding orders. We encourage clients to visit my website, Zola page, or facebook page to see my portfolio  It is easier to choose cakes or other confections that will coordinate with the look and feel of your event if you have done some essential planning before you discuss with me. If you are still deciding on a design, flavor(s), and size, I won't be able to provide the best quote for your needs.  It is helpful to have a preliminary budget in mind before you come to the meeting. Try to be flexible about your design, practical about your budget, and mindful about your needs.

 

My wedding cake tasting provides a sample of the quality of my delicious cakes. While I will make every effort to provide you with an excellent selection of the cakes you would like to try, I am limited to my popular flavors and those recently ordered. I allow our clients to request three flavors they want to sample during their consultation. 

Cake tasting kits are available, and consultations are subject to availability.

Before booking you, you should have your wedding date and venue secured and a good idea of the theme and colors you wish to use. I suggest planning your tasting 6-9 months in advance if you haven’t booked with me. If you have already placed your booking fee, I suggest a tasting be planned 2-3 months prior to wedding date.

 

Wedding Cake Tastings are also available for pickup if you prefer to take home and decide together. Pickup tastings are $50, and we will not meet in person. 

 

*Design Alterations

Your order is important to me, so please take the time to check the details of your order carefully. You are responsible for contacting us about any changes required to your original order. Any changes made to your original design after the order has been secured with a booking fee are subject to a design change fee and a difference in the quoted price. Tays Sweet Shop will try and accommodate any changes where possible. However, I cannot guarantee to do so and reserve the right to increase the price quoted for any extra work needed. You will not be refunded for supplies that may no longer be needed but have already been purchased.  Please note that my bakery cannot make any changes within 14 days of the delivery/collection/shipping date for celebrations or one month for weddings. 

 

*Cake Decorations

You assume full responsibility for removing non-edible cake décor from your cake before cutting or serving. This includes but is not limited to name tags, cake toppers or any items standing on the cake, rhinestone decorations, ribbons, sugar flowers, artificial flowers, etc. While some of these items may be made from edible materials, they may not be intended for consumption. Items such as wires, skewers, dowels, or other items are used for strength and flexibility to achieve the desired appearance of the decoration. I strongly advise against eating décor. Be mindful of placing décor items from cakes in reach of or near children and other guests. 

 

*Fresh Flowers 

Tays Sweet Shop is not responsible for supplying any fresh flowers, unless agreed upon at the time of booking. If you intend to use fresh flowers on your wedding or celebration cake, you must obtain flowers from an outside reputable florist. Fresh flowers are not food products and may contain pesticides, insects, dirt, or other contaminants. Please note that some flowers as not suitable for use on cakes, such as baby’s breath, eucalyptus, and more. 

 

Tays Sweet Shop will carefully prepare the flowers and arrange them on the cake for an additional fee. You assume all liability and responsibility for the condition of the cake altered by anyone other than Tays Sweet Shop.

 

*Color Matching

I ask that you provide a swatch or photo of the shade you would like for color matching. Tays Sweet Shop will do its best to match any color requests for icings. I aim for a perfect match, but this is not always possible. I will do my best to color match (within three shades darker or lighter) samples given to me, but please keep in mind that I am working with a food product and edible colors.

Light vastly affects colors, and I cannot guarantee exact color matches or color stability.  Cakes should be displayed out of direct sunlight to keep colors from fading. Please be advised that dark colors sometimes taste slightly bitter or stain.

 

*Equipment Rental

A security deposit is required for your rented items in case of loss, theft, or damage. All rental items will be for three days, including the day of the event, plus two days after. A late fee of $20 per day will be imposed for each day the item(s) are late. If any rented items are not returned or damaged in any way, the client will be responsible for the cost of replacing the entire item. The security deposit will be refunded when all rental items are cleaned by the client and returned in the same condition. If rented items are not cleaned upon return, or there is any damage, the security deposit will not be refunded. 

 

*Presentation & Display

While Tays Sweet Shop tries to ensure that products are well presented and look the absolute best, the stability or levelness of the table upon which the items are displayed or the quality of the environment around the items is outside my control. Please ensure the “presentation table” is stable, level, and sturdy enough to hold the display. If the items are to be set up by the venue staff, once the order is delivered/collected, Tays Sweet Shop is not responsible for any interference or damage by the persons setting up.

 

*Serving sizes

Serving size estimations are not guaranteed to be exact. Specialty cakes, carved cakes, and methods of slicing may affect the total serving number. 

My bakery can provide a cake-cutting guide, if requested, (except for carved cakes) with your order for you to follow to get the ordered serving count.

 

Tays Sweet Shop is not responsible for the shortage of any servings, as I will discuss the best size for the product during the ordering process. 

 

*Quality and Storage

Your order will be baked as close to your delivery/collection day as possible to ensure quality and freshness. Cakes covered with fondant or fondant décor should be stored in a cool, dry place, preferably in the box that they are supplied in. They should not be refrigerated. We suggest that cakes should be eaten as close to the delivery/collection date as possible. Tays Sweet Shop advises that all food must be consumed within 24 hours of the first serving. Any food consumed after 24 hours or later is at the client’s discretion and becomes their responsibility. Once products have been delivered, the responsibility of consumption lies with the customer and, therefore, indemnifies Tays Sweet Shop of all liability for personal use.

 

*Allergies

Please be aware that should you need allergen friendly items, there is the chance of cross-contamination from other items baked and/or prepared. I do my best to clean and sanitize between orders with and without allergens. Tays Sweet Shop will not be held liable for any allergic reaction resulting from the consumption of any products. 

 

*Weather

Heat and humidity can adversely affect my product(s). In warmer months, it is advised that the product(s) be kept in an air-conditioned area or, at the very least, a cool area. (Refrigeration is not recommended for fondant cakes). It is strongly suggested that the product(s) being collected by the customer are transported in an air-conditioned vehicle. Tays Sweet Shop is in no way responsible for any damage that may occur due to weather conditions.

 

*Transportation 

Safe transportation of any products is crucial. When collecting any items, please follow these tips/procedures:

-Transport in an air-conditioned vehicle

-Place all items on a flat surface (floorboard). Please do not place any items purchased in a persons lap for transportation. 

-Be cautious of any bumps, turns, or sudden stops to ensure the stability of the products is not damaged in any way. 

-Once collection has been completed, Tays Sweet Shop is not responsible for any damaged caused during transportation. 

 

*Exemption

Where damage does occur to the irrefutable fault of Tays Sweet Shop, a partial or full refund may be given. This will be determined on an individual basis. Proof must be provided immediately, either in person or by way of pictorial evidence. The customer is made aware that specific designs (e.g., topsy-turvy) are more structurally sensitive than others. Improper handling can lead to damage. Assuming all precautions have been taken by myself to provide you with sound structural support, Tays Sweet Shop accepts no liability for any damage that may occur once products are in the customer's possession.

 

*Photographs

Tays Sweet Shop reserves the right to use all photographs of the products for advertising purposes without compensation to you.

 

*Liability

Tays Sweet Shop is not responsible for bodily injury or consequential damage which may result from services.

 

By placing an order with Tays Sweet Shop, you agree to all the above Terms and Conditions in their entirety.
